Welcome to the official hideout of Pirate Terrible. These Terms of Service (“Terms”) govern your use of our website pirateterrible.com and the purchase of our handcrafted artifacts. By accessing our site or placing an order, you agree to be bound by these Terms.
1. THE ARTISAN NATURE OF OUR TREASURES
All products offered by PIRATE TERRIBLE are handcrafted, 3D-printed, and hand-painted artifacts.
- Artisan Variations: Because each piece is finished by hand, minor variations in color, texture, and detail from the product images are expected and represent the unique nature of artisan work.
- Fan-Art Disclaimer: Our products are unofficial, fan-made tributes and artistic interpretations. We are not affiliated with, endorsed by, or sponsored by any official trademark holders. These pieces are intended for collectors and fans.
2. MANUFACTURING (THE “FORGE”)
- Made-to-Order: Most items are forged specifically upon request. Manufacturing times (the “Forge” period) are estimated on each product page.
- Cancellations: Once the manufacturing process has begun, orders cannot be cancelled or modified, as materials and labor are specifically allocated to your bespoke piece.
3. PRICING AND PAYMENTS
- Currency: All prices are displayed in Euros (€).
- Taxes: For EU customers, prices include Spanish VAT (IVA).
- Secure Payments: We use industry-standard encrypted gateways (Stripe, PayPal, Klarna). We do not store your credit card information on our servers.
4. INTERNATIONAL SHIPPING & CUSTOMS
We ship from our workshop in Madrid, Spain to the EU, North America (USA/Canada), and Latin America.
- Mandatory Information: You must provide a valid phone number at checkout. International carriers and Customs authorities will not process shipments without it.
- Importer of Record: For orders outside the European Union, the buyer is the “Importer of Record.”
- Duties and Taxes: Any Customs duties, import fees, or local taxes (e.g., Sales Tax, ICMS, etc.) are the sole responsibility of the buyer. Pirate Terrible is not responsible for packages held or returned due to non-payment of these fees.
5. REFUND AND RETURN POLICY
In accordance with Article 103 of the Spanish General Law for the Defense of Consumers and Users and international standards for personalized goods:
- Final Sale: Returns and exchanges are not accepted for handcrafted, made-to-order, or personalized items.
- Shipping Damage: If a treasure arrives damaged, you must notify us at info@pirateterrible.com within 48 hours of delivery with photographic evidence of the packaging and the item.
6. LIMITATION OF LIABILITY
Our artifacts are designed as collector’s display pieces, not mass-produced toys. They may contain small or fragile parts. PIRATE TERRIBLE is not liable for any damage or injury resulting from the improper handling, use, or display of these handcrafted items.
7. INTELLECTUAL PROPERTY
All content on this website—including text, images, custom 3D designs, and logos—is the property of PIRATE TERRIBLE or used under legitimate rights. Unauthorized reproduction or commercial use of our original designs is strictly prohibited.
8. GOVERNING LAW AND JURISDICTION
These Terms are governed by the Laws of the Kingdom of Spain. For the resolution of any conflict or dispute, the parties expressly submit to the exclusive jurisdiction of the Courts of Madrid, Spain, waiving any other jurisdiction that may apply.
